Terms & Conditions
These Terms & Conditions set out the basis on which SMK Marketing provides consultancy and related services.
1. Business information
SMK Marketing is operated by Seán Kennedy as a sole trader, trading as SMK Marketing. You can contact SMK Marketing using the contact details provided on this website, including the published email address. SMK Marketing does not currently publish a trading address on this site. If Irish or EU consumer law requires a geographical address to be disclosed for your particular contract, this will be confirmed directly with you before or at the time of booking.
2. Consultancy bookings and cancellations
All bookings for consultancy sessions are subject to availability and confirmation. If you need to cancel or reschedule a booking, you should provide at least two hours’ notice using the contact details provided on this website. If you do not attend a booked session and do not provide any notice, a charge equal to 50% of the session fee may apply. These booking and cancellation terms operate subject to any mandatory statutory consumer rights that apply and are not intended to limit or exclude those rights.
3. SMK Advisory
The SMK Advisory service provides ongoing monthly support, currently priced at €250 per month. Unless otherwise agreed, your Advisory payments are taken on a recurring basis. You may cancel your Advisory subscription by giving at least 48 hours’ notice before your next scheduled payment date, using the contact details provided on this website. Subject to applicable law and any requirements of the relevant payment provider, cancellation will take effect from the next billing date confirmed to you. No minimum subscription term, additional cancellation fees or other commitments apply beyond those expressly agreed with you.
4. Payments
Payment arrangements for SMK Marketing services will be confirmed with you during the booking or invoicing process. Depending on the service and the configuration of SMK’s systems at the time, payment may be taken through Wix Payments (once that facility has been fully configured and activated) and/or by direct invoice payable through Revolut Business. Any applicable taxes, including VAT, and the timing of payment will be confirmed to you before you are asked to pay. Nothing in these terms is intended to add fees or charges beyond those clearly communicated to you in advance.
5. Consultancy services and advertising
SMK provides independent advice. While we offer recommendations for advertising and marketing channels, the final decision and responsibility for any ad spend rests with the client. Advertising through partner podcasts is subject to separate availability and terms.
6. Consumer rights and statutory cancellation
Your rights to cancel or withdraw from a contract with SMK Marketing depend on the type of service you purchase and the consumer protection laws that apply, including Irish and EU consumer law where relevant. In some cases, you may have a statutory right to cancel a distance contract within a certain period; in others, different rules or exceptions may apply. Where a statutory withdrawal or cancellation right exists, SMK Marketing will explain how it works and how you can exercise it. If you ask SMK Marketing to begin providing services during any applicable withdrawal period, this may affect how that right operates and what, if any, refund you are entitled to. These terms are not intended to remove or reduce any rights you have under mandatory consumer law. Additional information or forms required by law (for example, specific cancellation information or a model cancellation form) will be provided where applicable and may require separate legal confirmation.
7. Liability and intellectual property
All materials provided during consultancy remain the intellectual property of SMK Marketing unless otherwise agreed. Our liability is limited to the fees paid for the specific service in question.
8. Privacy and data protection
Your privacy is important to us. We handle all personal data in accordance with our Privacy Policy and GDPR requirements. We will never share your business details with third parties without your consent.
9. Changes to these terms
We may update these terms from time to time. The latest version will always be available on our website. Continued use of our services after updates constitutes acceptance of the new terms.
